Terms of Use

Bethany Caliston | Caliston Wellness
Website: https://www.calistonwellness.com
Effective date: 10/2/26

1. About these terms

These Terms of Use apply to the website operated by Bethany Caliston, doing business as Caliston Wellness (“we,” “us,” or “our”). They describe permitted use of our website and its content. Where you are asked to accept these terms, your affirmative acceptance constitutes agreement to them. Nothing in these terms limits rights that cannot lawfully be waived.

2. Educational content and professional advice

Our website and newsletter provide general information about movement, fitness, mobility, and wellness. This content is for educational purposes and is not medical advice, diagnosis, treatment, physical therapy, or individualized healthcare.

Visiting the website, subscribing to the newsletter, or submitting an inquiry does not establish a healthcare provider–patient relationship or an ongoing coaching relationship. Individual services, if arranged, are governed by a separate agreement.

Consult a qualified healthcare professional before beginning or changing an exercise or wellness program, particularly if you have an injury, health condition, or other concern. Do not disregard professional advice or delay seeking care because of something you read on this website.

3. Exercise and individual results

Exercise involves risks, and a movement that is appropriate for one person may not be appropriate for another. Choose activities suited to your abilities and circumstances, follow instructions carefully, and stop if you experience pain, dizziness, or other concerning symptoms. Seek appropriate care when needed.

Results depend on individual circumstances, consistency, and other factors. We do not guarantee a particular fitness, mobility, health, or other outcome. Testimonials describe individual experiences and do not guarantee that you will achieve the same results.

4. Intellectual property

Unless otherwise identified, website content—including original text, photographs, videos, graphics, downloadable materials, and branding—is owned by us or used with permission and is protected by applicable intellectual property laws.

You may view the website and use materials expressly provided for personal use according to any accompanying instructions. Except as permitted by law or with the rights holder’s written permission, you may not reproduce, distribute, sell, publicly display, or adapt protected content, or use it to create commercial courses, training materials, or other products.

These terms do not restrict fair use, other lawful exceptions, or use of ideas and information that are not protected by intellectual property law. Third-party names and trademarks belong to their respective owners.

5. Acceptable use

Do not use the website for unlawful activity, submit fraudulent or abusive messages, introduce malicious software, attempt unauthorized access, or interfere with website security or operation. Do not impersonate another person or submit someone else’s private information without authorization.

We may restrict access where reasonably necessary to address misuse or protect the website, subject to applicable law.

6. Contact forms and newsletters

Please provide accurate contact information and submit only information you are authorized to share. Our general contact form is not intended for medical emergencies or confidential medical records. For an emergency, contact appropriate emergency services.

Submitting a contact form does not enroll you in our newsletter. If you subscribe, you may unsubscribe using the link in our marketing emails.

You retain ownership of your messages. By submitting an inquiry, you permit us to receive, store, and use it as reasonably necessary to respond and administer the communication, consistent with our Privacy Policy. We will not publish your message as a testimonial without your permission.

7. Privacy

Our Privacy Policy explains how we handle personal information collected through the website and newsletter. Please review it through the “Privacy Policy” link on our website. These terms do not replace that policy or authorize data practices beyond those disclosed in it.

8. Third-party links

The website may link to third-party websites, products, or services. We do not control their content, availability, or practices. Any transaction with a third party is subject to its terms and policies. Where a link or recommendation involves compensation or another material connection, we will disclose that connection as required by law.

9. Website availability and warranties

We make reasonable efforts to provide useful information, but content may contain errors or become outdated. We may update content or temporarily interrupt access for maintenance or other operational reasons.

To the extent permitted by law, the website and its general educational content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. This provision does not disclaim warranties or obligations that applicable law does not allow us to disclaim.

10. Liability and protected rights

To the extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential damages arising from use of, or inability to use, the website.

Nothing in these terms excludes or limits liability for fraud, willful misconduct, gross negligence, violations of law, or any other liability that cannot lawfully be excluded or limited. These terms do not waive nonwaivable consumer rights and are not a release of liability for participation in an exercise session or other service.

11. California law

California law governs these terms, except where applicable law requires otherwise. Nothing in these terms deprives you of mandatory legal protections or access to a court or forum available under applicable law.

12. Changes

We may revise these terms and will post the revised version with an updated effective date. Material changes will be identified through a prominent website notice. Changes apply prospectively. If affirmative acceptance is required for a change, we will request it before the change becomes binding.

13. General provisions

If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
